Now the supremes say that judges alone cannot decide capital punishment, juries must choose. This is interesting. If there are enough constraints placed on the implementation of capital punishment it may be done away with. Few politicians want to come right out and agitate for the end. The supremes, by ruling that one thing and then another are not allowed, are slowly whittling away the viability of capital punishment without having to rule on the constitutionality.
